Viewing and Editing Violation Details

Overview

Violation details are managed on the Violation Details page. To open this page, click the violation on the Violations page or the related site, the Violations tab of the related evaluation, or the Linked Violations tab of the related compliance action.

Navigation Tabs

The following navigation tabs appear across the top of the Violation Details page.

Sample results related to the violation.

This tab only appears for applicable violation types.

Docket

Information on the evaluation that first identified the violation and any compliance actions that reference it.

 

Fields

The Violation Details page is organized into four sections: Key Details, ICIS-NPDES Single Event Violation (SEV) Data Elements (if applicable), Comments, and a right-hand sidebar.

Key Details

The following fields appear in the Key Details section.

Program Area

The program area that the violation is associated with.

 

Violation Category

The category of the violation.

The selected category determines which types appear in the Violation Type field.

Violation Type

The type of violation.

Available types are determined by the selected category.

Parameter

The sampling parameter, analyte, or pollutant to which the violation relates.

This field only appears for applicable violation types.

Start Date

The date the violation condition began or was first identified.

The specific meaning depends on how the agency uses this field.

Non-Compliance End Date

The date the violation condition ended.

This field can also be used in different ways depending on agency practices. For example, it could indicate the date the violation was addressed via a compliance or enforcement action.

Guidance for ICIS-NPDES SEVs:

“This field should be left blank if the SEV is ongoing (i.e., violation has not yet been corrected at the time of data entry into ICIS-NPDES). The regulatory authority should set this date to when the particular violation ends (e.g., sanitary sewer overflow from a broken pipe has stopped).”

Continuous Period

A checkbox used to indicate that the violation condition occurred on an ongoing basis between the start and end dates.

 

Is Significant Non-Compliance or HP Violation

A checkbox used to indicate whether the violation is significant.

Use of this checkbox is at the discretion of the agency or program. Selecting it does not affect system behavior.

ICIS-NPDES Single Event Violation (SEV) Data Elements

This section appears when the selected violation category and violation type combination has an ICIS-NPDES SEV Code assigned. Data entered is used for transmitting SEVs to ICIS-NPDES.

U.S. Environmental Protection Agency (EPA) Note: “The four RNC fields are related to the legacy Quarterly Noncompliance Report (QNCR) and the use of significant noncompliance as a program management tool. The QNCR is currently in the process of being replaced by the NPDES Noncompliance Report (NNCR), which does not use the four RNC related fields from ICIS-NPDES. The NNCR includes all SEVs (regardless of the presence or absence of the four RNC fields). For more information, see the NNCR Technical Support Guide.”

The Reportable Non-Compliance (RNC) detection type, as defined by ICIS-NPDES.

 

RNC Detection Date

The date the RNC violation was detected.

 

RNC Resolution Code

The RNC resolution type, as defined by ICIS-NPDES.

 

RNC Resolution Date

The date the RNC violation was resolved.

 

Comments

The following fields appear in the Comments section.

Specific Violation Reference (for inclusion on letter / notice)

The statute, regulation, or law to which the violation relates.

To change the violation status, click the Update Status button. nVIRO may also be configured to automatically change violation statuses when certain conditions are met.

Site

The name and address of the site to which the violation relates.

The site name is linked to the site record.

Source Evaluation

The evaluation that first identified the violation.

The evaluation name is linked to the evaluation record.

View History

A button that opens an audit of changes made to the project activity over time.
